Third Party Insurance Guidance - Ratae R.C.

UPDATED - 11th August 2019

Third Party Insurance - Guidance Note for Members of The Ratae Road Club

From time to time the Club receives enquiries from members about the Insurance Cover provided by the Policy we have taken out with CyclingUK.

These notes below, are intended to clear up any misunderstandings, and give some guidance and advice regarding the liabilities of indivdual members.

------------------------------------------------------------------------------------

The Club's Insurance

The Club's Insurance Policy only covers claims for injury or damage caused to a third party, made against the Club, it's officers or Ride Leaders that might arise from an incident during a Club or organised ride.

The Club wishes to make it clear that individual members of the Club are NOT covered by the Club's insurance.

This means that, if you cause injury or damage to a third party ( who for example, could be a fellow rider on a Club run, or any other road user ), a claim may be taken out against you.

We therefore offer this guidance as to what you should do to minimalise your risk to a claim for damages.

Personal Insurance

11th August 2019 - We are issuing a reminder to members of the good sense in taking out third party insurance cover. This is in the light of the recent London County Court case of the cyclist Robert Hazeldean who had damages and costs of almost £100,000 awarded against him after colliding with a pedestrian. He was uninsured but if he had had insurance the claim would have been settled by his insurer. Whilst this cyclist has won widespread sympathy based on the facts of the crash, the case does show how the courts apportion blame and the amounts awarded in damages. Our revised “Third Party Insurance Guidance” below, includes details of how to apply for Affiliate membership of CyclingUK at a reduced rate.

The Ratae Road Club strongly recommends that every member arranges his or her own third party insurance cover.

Third Party Insurance is offered as an inclusive part of membership of both CyclingUK and British Cycling, (see their websites for details).  As the Ratae R.C. has Club Membership of CyclingUK, this entitles all of its members to take out “Affiliate Membership”, which is cheaper than taking out “Full” membership as an individual.  (2019 prices are - 'Full' = £46pa, 'Affiliate' = £25pa).  If any Ratae member wishes to take out CyclingUK Affiliate membership you can do this by applying online where you will be prompted to enter our club number which is: 8002026.

Although Ratae R.C. also has club membership of British Cycling, B.C. does not have an affiliate category. However BC do offer a first year 50% discount for all their various membership categories.  You can also arrange cover through some Home Insurance Policies or purchase a stand alone Policy.

In giving this guidance the Club wishes to make it clear that it is not authorised to give advice on which type of Insurance suits you, nor is it making any recommendations regarding taking out CyclingUK or British Cycling membership. Please shop around for the best cover for your types of riding.

--------------------------------------------------------------------------------------

The Club Committee are indebted to, and would like to thank John Fox for his research into this complex area to produce the valuable advice that he has set out above.

The Committee strongly agree with John's recommendations, that individuals should take out their own personal insurance.

Previous Review by John Fox - 19th February 2018

Re our CyclingUK insurance, I’ve checked the cover for “affiliated bodies” which was updated on 5/12/2017, but with no significant changes.

The Club has cover for injury or damage claims against the club or its officers during organised rides/events which are either:

  • “primarily for our members” (Club runs and Chain Gang).
  • or
  • “rides which are for both members and the public” (Reliability and Rouleur).
  •

Cover is for officers involved in the running of the ride/event whether they are ride leaders, marshals or similar

The mandatory provisos are that the ride:

  • has less than 200 riders.
  • we are aware of all riders’ names (can be collected orally or in writing).
  • does not exceed one day in duration.
  •

The guidelines provisos are:

  • non-members should not take part in more than three rides.
